Adoption can help families formalize their relationships with each other. Stepparents, grandparents, and other family members often step up and raise children in their family when the birth parents cannot or will not parent. If you are raising a child who is not yours, you may be able to adopt that child or obtain a guardianship.

Litowich LawThere are many situations when adoption or guardianship makes sense. Some examples: when a birth parent has passed away, is incarcerated for a long period of time, or has abandoned or is neglecting the child.

Adoption terminates the biological parent's rights and replaces them on the birth certificate with the people or person who adopts the child. This gives the adoptive parent or parents the same rights and obligations relative to the child as the birth parents had before the adoption. Adoption is permanent.

Guardianship is a less permanent option. A person might want a guardianship if they want to be able to make medical and education decisions for a child while the birth parent is temporarily unable to make those choices. Obtaining a guardianship will not terminate the birth parent's rights and can be terminated or relinquished.
